Kullanım Koşulları ve Son Kullanıcı Lisans Sözleşmesi
Bu koşullar; Wind web sitesini (“Site”), Wind hesabını (“Hesap”), WindLib kütüphanesini ve Wind adlı SketchUp eklentilerini (birlikte “Yazılım”) kullanman için geçerlidir. Yazılımı ya da Siteyi kullanarak, hesap açarken ya da lisans satın alırken bu koşulları kabul etmiş olursun. Kabul etmiyorsan Yazılımı kullanma.
1. Taraflar
Yazılımın sahibi ve hizmet sağlayıcı: , , e-posta: (“Wind”, “biz”). Karşı taraf, Yazılımı ya da Siteyi kullanan gerçek ya da tüzel kişidir (“sen”, “kullanıcı”).
2. Tanımlar
- WindLib: Bütün Wind eklentilerinin ortak kütüphanesi (lisans, dil, katalog, kurulum ve güncelleme).
- Eklenti: WindLib'e bağlı çalışan her Wind eklentisi (ör. Wind Furniture, Wind Loft).
- Ücretsiz özellikler: Lisans gerektirmeden çalışan özellikler.
- Pro özellikler: Geçerli bir lisansla açılan özellikler.
- Lisans: Pro özellikleri belirli eklentiler (ya da hepsi) için belirli bir süre açan, anahtarla tanımlanan kullanım hakkı. Türleri: satın alınan, deneme, hediye.
- Satış platformu: Ödemeyi alan, faturayı düzenleyen ve vergiyi tahsil eden aracı satıcı (ör. Paddle, Lemon Squeezy, Gumroad).
3. Hesap
- Hesap açmak için 18 yaşını doldurmuş olmalısın; 18 yaşından küçüksen velinin ya da vasinin izniyle kullanabilirsin.
- Kayıtta doğru ve güncel bilgi vermelisin. Bir hesap bir kişiye aittir; başkasıyla paylaşılamaz.
- Şifrenin gizliliğinden sen sorumlusun. Hesabının izinsiz kullanıldığını düşünürsen şifreni değiştir ve bize haber ver.
- Hesap olmadan da Yazılımı kullanabilirsin; hesap, lisanslarını ve cihazlarını tek yerden yönetmeni sağlar.
4. Lisans hakkı
- Wind, Yazılımı kullanman için sana kişisel, münhasır olmayan, devredilemez ve alt lisans verilemez bir kullanım hakkı tanır. Yazılımın mülkiyeti satılmaz, yalnızca kullanım hakkı verilir.
- Ücretsiz özellikleri herhangi bir süre sınırı olmadan, ticari işlerde de kullanabilirsin.
- Bir lisans aynı anda en fazla 3 bilgisayarda etkin olabilir (lisansta başka sayı yazıyorsa o geçerlidir). Bilgisayarını eklentiden ya da Hesabım sayfasından her zaman bırakabilirsin; başka bir cihazı uzaktan bırakma 30 günde en fazla 3 kez yapılabilir.
- Bir lisans bir kişi içindir. Ofis içinde birden çok kişi kullanacaksa her kişi için ayrı lisans gerekir.
- Yazılımla ürettiğin modeller, görseller, çizimler ve listeler tamamen sana aittir; ticari projelerde serbestçe kullanabilirsin.
5. Yasaklar
Şunları yapamazsın:
- Yazılımı kopyalayıp dağıtmak, satmak, kiralamak ya da başkasına kullandırmak (internetten herkesin indirebildiği resmi paketleri paylaşmak hariç);
- Lisans anahtarını paylaşmak, satmak ya da lisans denetimini atlatmaya, kırmaya, değiştirmeye çalışmak;
- Yazılımı tersine mühendislikle çözmek, şifrelenmiş kısımlarını açmak ya da kaynak kodunu elde etmeye çalışmak (yürürlükteki kanunun açıkça izin verdiği durumlar hariç);
- Yazılımdaki model, doku ve görselleri Yazılımdan bağımsız olarak, tek başına bir ürün ya da kütüphane gibi dağıtmak ya da satmak;
- Siteye ve sunucuya zarar verecek, aşırı yük bindirecek ya da başkalarının hesaplarına erişmeye çalışacak davranışlarda bulunmak.
6. Üçüncü taraf içerikler
Yazılımdaki mobilya kütüphanesinin bir kısmı üçüncü kişilerin özgür lisanslı içeriklerinden oluşur (CC0 ve CC BY 4.0). Bu içerikler kendi lisanslarına tabidir; yazar ve kaynak bilgileri Teşekkürler sayfasında ve Yazılım içinde gösterilir. SketchUp, Trimble Inc.'in tescilli markasıdır; Wind, Trimble ile bağlantılı değildir.
7. Satın alma, ödeme ve fatura
- Lisanslar satış platformu üzerinden satılır. Ödemeyi, faturayı ve satıştaki vergileri (KDV/satış vergisi) satış platformu işler; kart bilgilerin Wind'e ulaşmaz. Satın alma sırasında satış platformunun koşulları da geçerlidir.
- Fiyatlar satın alma sayfasında, vergiler dahil ya da hariç olduğu belirtilerek gösterilir.
- Satın alırken Wind hesabının e-posta adresini kullanırsan lisans hesabına kendiliğinden bağlanır; başka bir adres kullanırsan lisans anahtarı o adrese gönderilir.
8. Abonelik, yenileme ve iptal
- Abonelikler (aylık ya da yıllık) sen iptal edene kadar dönem sonunda aynı süre için kendiliğinden yenilenir. Yenileme ücreti dönem başında satış platformu tarafından tahsil edilir.
- Aboneliğini istediğin zaman iptal edebilirsin; iptal, ödenmiş dönemin sonunda geçerli olur ve o güne kadar Pro özellikler açık kalır.
- Lisans süresi bitince yalnızca Pro özellikler kapanır. Ücretsiz özellikler ve Yazılımla ürettiğin dosyalar etkilenmez.
- Fiyat değişikliği, değişiklikten sonraki ilk yenilemede geçerli olur ve en az 30 gün önceden duyurulur.
9. Cayma hakkı ve iade
- Yazılım, satın alma onayından hemen sonra elektronik ortamda teslim edilen dijital içeriktir. Mesafeli Sözleşmeler Yönetmeliği'nin 15. maddesi uyarınca, onayınla ifasına hemen başlanan dijital içeriklerde yasal cayma hakkı bulunmaz.
- Buna rağmen Wind, memnun kalmazsan satın almadan sonraki 14 gün içinde gerekçe sormadan ücret iadesi yapar. İade için satış platformunun iade bağlantısını kullanabilir ya da bize yazabilirsin. Abonelik yenilemelerinde iade süresi yenileme tarihinden başlar.
- İade edilen lisans iptal edilir. Lisansın kötüye kullanıldığı (ör. anahtar paylaşımı) durumlarda iade yapılmayabilir.
10. Lisans denetimi ve internet bağlantısı
- Pro özelliklerin açık kalması için WindLib lisansı ara sıra sunucumuzla doğrular. Bu sırada gönderilen bilgiler Gizlilik Politikası'nda açıklanır.
- İnternet yokken Pro özellikler son başarılı kontrolden sonra 7 gün çalışmaya devam eder. Bilgisayar saati geri alınırsa ya da lisans doğrulanamazsa Pro özellikler kapanır; ücretsiz özellikler her durumda çalışır.
11. Güncellemeler ve değişiklikler
- Wind, Yazılımı geliştirmek için güncellemeler yayınlayabilir. Güncellemeler zorunlu değildir; WindLib yeni sürüm olduğunu bildirir, kurmak senin kararındır.
- Özellikleri iyileştirebilir, değiştirebilir ya da yenilerini ekleyebiliriz. Lisans süresi içindeyken satın aldığın Pro özelliklerin özünü kaldırmayız.
- “Beta” ya da “deneme” olarak sunulan sürümler geliştirme aşamasındadır, hata içerebilir.
12. Garanti ve sorumluluk
- Yazılım özenle geliştirilir ve test edilir; ancak her bilgisayarda, her SketchUp sürümünde ve her modelde hatasız çalışacağı garanti edilemez. Yazılım “olduğu gibi” sunulur.
- Bazı araçlar modeli değiştirir (temizleme, hafifletme, bükme vb.). Önemli dosyalarının yedeğini al; değişiklikler SketchUp'ın “Geri al” komutuyla geri alınabilir.
- Kanunun izin verdiği ölçüde Wind'in sorumluluğu, zarara yol açan olaydan önceki 12 ayda o lisans için ödediğin tutarla sınırlıdır. Kâr kaybı, veri kaybı ya da dolaylı zararlardan sorumlu değiliz. Kasıt ve ağır ihmal hâlleri ile tüketicinin kanundan doğan hakları saklıdır.
13. Fikri mülkiyet
Yazılımın kodu, tasarımları, simgeleri, metinleri, Wind adı ve logosu Wind'e aittir ve fikri mülkiyet mevzuatıyla korunur. Bu koşullarda açıkça verilmeyen hiçbir hak sana devredilmiş sayılmaz.
14. Geri bildirim
Bize gönderdiğin öneri ve hata bildirimlerini Yazılımı geliştirmek için, sana ek bir ödeme yapmadan kullanabiliriz. Kişisel verilerin bu sırada da Gizlilik Politikası'na göre işlenir.
15. Fesih
- Hesabını istediğin an Hesabım sayfasından silebilirsin. Hesap silinince satın aldığın lisanslar silinmez; hesaptan ayrılır, anahtarla kullanılmaya devam eder.
- Bu koşulları ağır ya da tekrarlanan biçimde ihlal edersen (ör. anahtar paylaşımı, lisans kırma) Wind, önceden bildirerek ilgili lisansı ya da hesabı kapatabilir.
16. Değişiklikler
Bu koşulları güncelleyebiliriz. Önemli değişiklikler yürürlükten en az 30 gün önce Sitede ve (izin vermiş olsan da olmasan da, hizmetle ilgili bilgilendirme olarak) e-postayla duyurulur. Değişiklikten sonra Yazılımı kullanmaya devam etmen yeni koşulları kabul ettiğin anlamına gelir.
17. Uygulanacak hukuk ve uyuşmazlıklar
Bu koşullara Türkiye Cumhuriyeti hukuku uygulanır. Tüketiciler, 6502 sayılı Tüketicinin Korunması Hakkında Kanun uyarınca yerleşim yerlerindeki tüketici hakem heyetlerine ve tüketici mahkemelerine başvurabilir. Tüketici olmayan kullanıcılarla uyuşmazlıklarda Türkiye Cumhuriyeti mahkemeleri ve icra daireleri yetkilidir. Avrupa Birliği'nde yaşayan tüketicilerin kendi ülkelerinin zorunlu tüketici koruma kurallarından doğan hakları saklıdır.
18. İletişim
Terms of Use and End User License Agreement
These terms apply to your use of the Wind website (“Site”), your Wind account (“Account”), the WindLib library and the Wind SketchUp plugins (together, the “Software”). By using the Software or the Site, creating an account or buying a license, you accept these terms. If you do not accept them, do not use the Software.
1. Parties
Owner of the Software and service provider: , , email: (“Wind”, “we”). The other party is the person or entity using the Software or the Site (“you”).
2. Definitions
- WindLib: the shared library of all Wind plugins (license, language, catalog, installation and updates).
- Plugin: every Wind plugin that runs on WindLib (e.g. Wind Furniture, Wind Loft).
- Free features: features that work without a license.
- Pro features: features unlocked by a valid license.
- License: a right of use, identified by a key, that unlocks Pro features for specific plugins (or all of them) for a specific period. Types: purchased, trial, gift.
- Sales platform: the reseller that takes payment, issues the invoice and collects tax (e.g. Paddle, Lemon Squeezy, Gumroad).
3. Account
- You must be at least 18 years old to create an account; if you are younger, you may use it with the permission of a parent or guardian.
- Provide accurate and current information. An account belongs to one person and may not be shared.
- You are responsible for keeping your password secret. If you think your account was used without permission, change your password and tell us.
- You can use the Software without an account; the account lets you manage your licenses and devices in one place.
4. License grant
- Wind grants you a personal, non-exclusive, non-transferable, non-sublicensable right to use the Software. The Software is licensed, not sold.
- You may use free features without time limit, including for commercial work.
- A license can be active on at most 3 computers at a time (unless the license states another number). You can release a computer from the plugin or from your account page at any time; releasing another device remotely is limited to 3 times in 30 days.
- A license is for one person. If several people in an office use the Software, each person needs a license.
- Models, images, drawings and lists you create with the Software belong entirely to you and may be used freely in commercial projects.
5. Restrictions
You may not:
- copy, distribute, sell, rent or let others use the Software (sharing the official public download packages is allowed);
- share or sell your license key, or try to bypass, crack or modify the license check;
- reverse engineer the Software, decrypt its encrypted parts or try to obtain its source code (except where the law expressly permits it);
- distribute or sell the models, textures or images contained in the Software on their own, separately from the Software;
- harm or overload the Site or the server, or try to access other users' accounts.
6. Third-party content
Part of the furniture library consists of freely licensed third-party content (CC0 and CC BY 4.0). That content is subject to its own license; authors and sources are listed on the Credits page and inside the Software. SketchUp is a registered trademark of Trimble Inc.; Wind is not affiliated with Trimble.
7. Purchase, payment and invoices
- Licenses are sold through a sales platform, which handles payment, invoicing and sales taxes (VAT/sales tax); your card details never reach Wind. The sales platform's terms also apply to your purchase.
- Prices are shown on the checkout page, stating whether taxes are included.
- If you buy with your Wind account's email address, the license is linked to your account automatically; otherwise the key is sent to the address you used.
8. Subscriptions, renewal and cancellation
- Subscriptions (monthly or yearly) renew automatically for the same period until you cancel. The renewal fee is charged by the sales platform at the start of each period.
- You can cancel at any time; cancellation takes effect at the end of the paid period, and Pro features stay on until then.
- When a license ends, only Pro features stop. Free features and the files you created are not affected.
- Price changes apply from the first renewal after the change and are announced at least 30 days in advance.
9. Withdrawal and refunds
- The Software is digital content delivered electronically immediately after you confirm your purchase. Where the law provides that the statutory right of withdrawal does not apply to digital content whose delivery started with your consent, it does not apply.
- Even so, if you are not satisfied, Wind refunds you within 14 days of purchase, no questions asked. Use the sales platform's refund link or write to us. For subscription renewals, the 14 days start on the renewal date.
- A refunded license is revoked. Refunds may be refused where a license was abused (e.g. key sharing).
10. License check and internet connection
- To keep Pro features on, WindLib occasionally verifies your license with our server. The data sent is described in the Privacy Policy.
- Without internet, Pro features keep working for 7 days after the last successful check. If the computer clock is turned back or the license cannot be verified, Pro features turn off; free features always work.
11. Updates and changes
- Wind may publish updates. Updates are not forced; WindLib tells you a new version exists and you decide whether to install it.
- We may improve, change or add features. While your license is active we will not remove the essence of the Pro features you paid for.
- Versions offered as “beta” or “trial” are under development and may contain bugs.
12. Warranty and liability
- The Software is carefully developed and tested, but it cannot be guaranteed to work without error on every computer, SketchUp version and model. The Software is provided “as is”.
- Some tools change your model (cleaning, reducing, bending etc.). Back up important files; changes can be undone with SketchUp's Undo command.
- To the extent permitted by law, Wind's liability is limited to the amount you paid for the relevant license in the 12 months before the event causing the damage. We are not liable for lost profits, lost data or indirect damages. Liability for intent and gross negligence and consumers' statutory rights remain unaffected.
13. Intellectual property
The Software's code, designs, icons, texts and the Wind name and logo belong to Wind and are protected by intellectual property law. No right not expressly granted in these terms is transferred to you.
14. Feedback
We may use suggestions and bug reports you send us to improve the Software without paying you. Your personal data is still processed according to the Privacy Policy.
15. Termination
- You can delete your account at any time on your account page. Licenses you bought are not deleted; they are detached from the account and keep working with the key.
- If you seriously or repeatedly breach these terms (e.g. sharing keys, cracking the license), Wind may close the license or account after notifying you.
16. Changes
We may update these terms. Material changes are announced on the Site and by email (as a service message, regardless of marketing consent) at least 30 days before they take effect. Continuing to use the Software after the change means you accept the new terms.
17. Governing law and disputes
These terms are governed by the laws of the Republic of Türkiye. Consumers may apply to the consumer arbitration committees and consumer courts of their place of residence under Turkish Consumer Protection Law No. 6502. For disputes with non-consumer users, the courts and enforcement offices of the Republic of Türkiye have jurisdiction. Consumers living in the European Union keep the rights granted by the mandatory consumer protection rules of their country.
